Jamie Leppard found guilty of raping drunk, unconscious girl as her friend filmed it on mobile phone in Wainscott

A teenager has been locked up after a jury convicted him of raping a drunk and helpless girl as her friend filmed it on her mobile phone.

Jamie Leppard was remanded in custody as a judge warned he faced being sent into youth custody.

The 18-year-old victim was so inebriated that she was not aware of what happened until the friend later sent her the video clips.

Maidstone Crown Court heard she had earlier been to a birthday party in Chatham and drank “everything from vodka, Malibu, Bacardi, beer and wine”.

Around midnight in March last year she and a friend met up with Leppard, then aged 17.

They, Tommy Conway, 18, Harry Ludlow, 20, and others bought vodka and went to Leppard’s home in Wainscott. His parents were away. There, they played drinking games.

“She was the most drunk, not knowing what was happening or what she was doing,” prosecutor Nina Ellin told the jury. “She fell down. It seemed quite funny at the time.

“She could recall certain things but she had no significant memories of that night until she woke up the next morning in bed with Jamie Leppard.”

The girl’s friend had seen her and Leppard kissing. The others later saw him leading her up the stairs.

“Her friend described her as very drunk and wobbly as she walked,” said Miss Ellin. “About five minutes later she decided to go upstairs and record what was going on, thinking it might be funny."

She burst into the bedroom shouting: “Oi, oi”. She saw Leppard on top of her friend and said “Oh ****”.

As she filmed them, Conway and Ludlow ran into the room. Conway jumped on top of Leppard while he was having sex.

"The important thing to look at is when you see her face she is clearly unconscious or out of it, or passed out - or just asleep" - Prosecutor Nina Ellin

He and Ludlow were imitating Leppard’s motions and making groaning noises.

The jury of seven men and five women were shown the clips.

“The important thing to look at is when you see her face she is clearly unconscious or out of it, or passed out - or just asleep,” said Miss Ellin.

“Her head is back and she is not reacting, even with three men on top of her. You will hear laughter. She was lifeless. That must have been obvious to Jamie Leppard."

The friend went downstairs but reflected on what she had seen and went back. Leppard was now behind the girl having sex with her. Conway was lying near them.

Ludlow entered the room. Conway said “Man, give me a turn” as he fiddled with his bottoms.

Leppard then stopped having sex, saying: “No way. She is asleep innit. ******* a girl that’s asleep innit, that’s technical rape.”

They all left her naked and face down on the bed.

The friend later told her she had the clips. Horrified, she asked to see them and then contacted the police.

Leppard, now 19, of Sword Grove, Wainscott, denied rape, claiming the girl consented to sex.

It was the second time he had been on trial. At the first in March, he was cleared of one charge of raping the victim but the jury could not reach a verdict on a second charge.

Leppard shook his head after he was remanded. He will be sentenced with Ludlow, of Leeward Road, Rochester, and Conway, of no fixed address, on July 25.

Ludlow admitted one offence of sexual assault. Conway denied two offences of sexual assault, but was convicted.
